Terms of Sale

1. No implied warranty of merchantability. No implied warranty of fitness for a particular purpose. No other implied warranties. Experimental aircraft flight is an action sport and recreational activity, engaged in freely, and involving travel in three dimensions. Such activity is inherently dangerous and is subject to mishap, injury and even death; therefore a purchaser of such aircraft and/or parts of such aircraft assumes all the risks involved in its use. Since Progressive Aerodyne, Inc. cannot govern this activity, it hereby disclaims all liability.

2. Progressive Aerodyne, Inc. has its office and place of business located at 3801 State Rd 19, Tavares, Florida 32778. All sales are FOB Progressive Aerodyne, Inc.

3. Pricing and content of kits and options are subject to change without notice.

4. Site photos may be representational and not depict the listed part. When in doubt, customers must rely on the part number listed in the Assembly Manual or check with a Parts & Builder Support representative.

5. Parts availability may be subject to production scheduling and quantity pricing.

6. Deposits on Purchase Orders are required as follows: $5,000 for the Basic SeaRey Kit; $2,000 for the Carbon Graphite Hull; Full Price for Engines.

7. Customers will complete a Purchase Order Agreement for the Basic SeaRey Kit.

8. Parts and kit orders that exceed $3,000 must be paid by check, money order or wire transfer remitted to Progressive Aerodyne Inc.

9. Parts orders of less than $25 will pay a $3 small order administration fee.

Return / Credit / Claim Policy - Kits

1. Kit and Kit Upgrades and their individual components are Non-Returnable and Non-Exchangeable.

2. Any claims for Kit shortages, missing components or other issues must be made by original Kit purchaser within one year of date of Kit shipment or pick up.

3. Kit deposits and deposits for special order items are Non-Refundable.

Return / Credit / Claim Policy - Parts Orders

4. Any claims for parts order shortages or other issues must be made within 30 days of receipt

5. If return is pre-approved by Progressive Aerodyne Inc, a return fee of 15% will be applied to an individually purchased part if returned within 30 days of receipt and returned in new, unused, not-previously-installed condition.

6. Engines, instruments and special-order items are Non-Returnable.

7. Deposits for engines, instruments, or special-order items are Non-Refundable.
